1. Preamble
Personal training means supporting a person, personally and physically, towards autonomy in a process of change. It is a series of one-to-one sessions based on a collaborative relationship, focused on goals to be achieved and structured so that the person can develop their potential and raise their level of performance.
2. Purpose of the contract
This contract is a coaching contract as defined in the preamble above. Its purpose is the individual support of the client in optimising their physical and mental change, based on the needs the client expresses.
The precise wording of the goal, the definition of its scope and the criteria for assessing progress are the first objective of the client and the PointFit studio. Once finalised, they will be set out in an addendum signed by both parties and attached to this contract.
The client commits to predefined Personal Training packages, allowing training and progress to be planned calmly over a fixed period. The Personal Training package will be clearly stated on the invoicing documents and in the addendum to the contract.
Payment is due after the free first appointment following the signature of this contract, in cash, by bank card or by bank transfer. All details will appear on the invoice.
3.1 General
3.1.1 Under the terms of this contract, entitled “PointFit personal training contract”, the service provider undertakes to make himself available to the client as a Personal Trainer and will deliver one-to-one fitness training sessions of the duration specified in this contract.
3.1.2 The two parties will agree together, in advance, on the price, number and times of the sessions. These sessions will take place at the PointFit studio (31 rue Ernest Gossart, 1180 Uccle).
3.1.3 The coach cannot be held liable for any damage to clients’ personal belongings in the studio.
3.1.4 Items belonging to the PointFit studio, such as towels and toiletries, are provided as a courtesy to clients and only for the duration of their visit.
3.1.5 The PointFit studio may close its premises temporarily, in particular for works, repairs or public holidays. The coach informs the client in advance and the sessions concerned are rescheduled.
3.1.6 The client must behave respectfully in the coaching studio. If the client behaves in a rude, aggressive, violent, disrespectful, offensive or otherwise inappropriate manner, the client may be barred from the studio without prior notice and without refund of the remaining sessions.
3.1.7 The client takes part in the Personal Training sessions voluntarily.
3.1.8 The PointFit studio accepts no liability for any harm resulting from the practice of Personal Training outside the training sessions covered by this contract.
3.2 Health
3.2.1 Before the first session, the client completes the PointFit health questionnaire. If any answer is positive, the client provides a medical opinion authorising physical activity before the programme starts.
3.2.2 The client undertakes to inform the PointFit studio in writing of any change in their state of health (physical and mental) that could prevent them from exercising safely, and certifies that the information given in the intake questionnaire for their first Personal Training session is accurate.
3.2.3 In the absence of written information, the client releases the PointFit studio from any liability in the event of an incident occurring during or after a session.
3.2.4 The client bears full responsibility for their state of health (physical and mental). The PointFit studio accepts no liability for information not provided in the intake questionnaire for the first Personal Training session.
3.2.5 The PointFit studio undertakes to plan the training and run the sessions taking this information into account.
3.2.6 The client is aware that their participation in Personal Training sessions is voluntary and at their own risk. They may at any time ask to stop, or refuse to perform an exercise, if they believe it could be dangerous to their health.
4. Payment terms
4.1 Coaching sessions must be taken before the expiry date. If sessions are not taken before the expiry date for reasons attributable to the client, they cannot be refunded in whole or in part.
4.2 The client is only admitted to a training session once the amount due has been paid. In the event of late payment, training will be suspended.
4.3 If the client stops attending Personal Training sessions part-way through, for whatever reason, the amounts agreed when the contract was signed remain due to the PointFit studio.
4.4 When renewing the contract, the client must first pay any amounts still due under the previous contract.
4.5 Personal Training packages have a validity that varies with the number of sessions; they are transferable but non-refundable.
4.6 In the event of illness (medical certificate required) or a house move, Personal Training sessions may be postponed or transferred to another person.
4.7 Any session cancelled at least 24 hours in advance is rescheduled in agreement with the coach, preferably within 7 days. Failing that, it remains usable until the end of the programme’s validity period. Any session cancelled less than 24 hours in advance is due, unless it can be rescheduled in agreement with the coach. Cases of force majeure are left to the discretion of the coach.
5. Results guarantee
5.1 If the client has completed all the sessions of their programme within the validity period and has not progressed on any of the indicators set in writing at the initial assessment, PointFit offers 4 additional sessions, to be used within 6 weeks. The guarantee gives no right to any refund and applies only once per client.
By making payment, the client declares that they have read, understood and accepted the general terms and conditions (above) of this contract, which form an integral part of it.
